Publishing Agreement

This agreement explains how music created with Un Desierto may be released, published, and monetized when a customer chooses to move beyond private use.

1. Purpose of This Agreement

This Publishing Agreement applies only when a customer chooses to release a song publicly. If a song is created for private use only, this agreement does not apply.

2. Private Use vs. Published Release

By default, all custom songs are created for private, personal use. Private songs may not be uploaded, distributed, monetized, or shared publicly.

Publishing a song is optional and requires explicit approval from Un Desierto under the terms described in this agreement.

3. Label & Ownership

All published songs are released under the Un Desierto record label. Un Desierto retains ownership of the master recording and distribution rights.

The customer is credited as the artist on the released song.

4. Artist Credit

Upon publication, the customer will receive artist credit as agreed upon prior to release. Credit format (artist name, spelling, capitalization) must be approved before distribution.

5. Revenue Sharing

Revenue generated from a published song is shared between Un Desierto and the credited artist. Revenue sharing applies only to the specific published song.

Revenue terms are communicated prior to release and do not apply to any other projects, services, or songs.

6. Publishing Process

  1. The customer requests publication.
  2. Un Desierto reviews and approves the request.
  3. Publishing terms are confirmed.
  4. The song is prepared for release.
  5. The song is distributed under Un Desierto.

7. Restrictions

Customers may not upload, distribute, monetize, or claim ownership of the song outside of Un Desierto without written permission.

Unauthorized uploads or distribution may result in removal of the song and termination of publishing privileges.

8. Creative Process & Tools

Un Desierto may use a combination of creative tools and human curation as part of the production process. Final releases are reviewed and approved by Un Desierto prior to distribution.

9. No Guarantee of Commercial Success

Music performance is subjective. Un Desierto does not guarantee streams, revenue, chart placement, or commercial success.

10. Termination

Un Desierto reserves the right to remove or discontinue a release if terms are violated or if the relationship becomes unworkable.

11. Governing Law

This agreement is governed by the laws of the United States and the applicable state of operation for Un Desierto.

By requesting publication of a song, you acknowledge and agree to the terms of this Publishing Agreement.
